Who you are buying from

firelet.media Gallery is made and published by [Your full legal name, as on your ID], trading as firelet.media, of Islamabad, Pakistan. That is one person and not a company — a sole trader — and that person is who you are contracting with. In these terms “we” and “us” mean [Your full legal name, as on your ID], and “you” means the person or business buying or using the program.

Paddle is the merchant of record for purchases made through this site. Paddle.com Market Ltd sells the licence to you, takes the payment, and is responsible for charging and remitting any sales tax, VAT or GST your country applies. Your order and your receipt are with Paddle; the licence you receive, and the program itself, are ours. That is why the name on your card statement is Paddle rather than ours, and why Paddle can answer a billing question as authoritatively as we can.

Buying the gallery, and going on using it, is how you accept these terms. If you do not accept them, do not buy it — and if you already did, the refund policy is how you undo that, within the window and without an argument.

What the licence gives you

Buying the gallery buys a perpetual licence to run it. It is not a subscription and not a rental. If you never pay us again it keeps working — on this machine, on a replacement in five years, with no internet connection at all. Nothing in these terms lets us switch off a copy you have paid for.

The licence activates on one machine at a time. You may move it between machines as often as you like: release the seat from your account, then activate the next one. Moving costs nothing and there is no limit on the number of moves.

The licence is for you — one person, or one business — and is not for sublicensing, resale or sharing beyond that.

What you buy is the right to run the program, not the program. We keep ownership of the gallery and of everything around it — the software and its source, the documentation, the name and the marks — and nothing in these terms hands any of that over.

Updates

Updates are bought separately, by the window, and you never have to buy one. An updates window runs for a year and can be bought at the checkout or later from your account, at the same price either way.

Every release published inside a window you bought is yours permanently. When the window ends nothing is taken away: the program does not stop, and every build from inside that window still installs and runs, on a new machine, years later. What ends is your entitlement to releases published after it. Buy another window whenever you want those; skipping one costs nothing later, and there is no back-pay and no lapsed rate.

We do not promise how many releases a window will contain. Nobody honestly can. What is promised is the window itself — whatever ships inside it is yours, whether that turns out to be two releases or twenty.

The free trial

The gallery runs a 30-day free trial with every feature switched on, capped at a set number of pictures, so you can judge it on your own photographs rather than on a screenshot. The trial asks for no payment details. When it ends the program stops indexing new pictures; it does not delete anything it has already read, and it never touches your originals.

Activation, and working offline

Your licence key is checked when you activate it and re-checked roughly once a month afterwards. Between those checks the program runs entirely offline, and it keeps running for about three months with no connection at all before it asks again. This is a check that you still hold the key, not a check for permission to run.

Keep your key. It can be re-sent from your account and through the support form, but it is what proves the purchase.

What you may not do

• Resell, rent, sublicense or redistribute the program or your licence key.
• Use a key beyond the seats it grants, or publish one.
• Work around the licensing — patching it out, forging a key, or defeating the activation check.
• Reverse-engineer the program, except where the law allows it regardless.
• Use it to process material you have no right to process.
• Break the law with it, or use it to help somebody else break the law.
• Use this site or an account here for fraud or spam — including registering under somebody else's name, or paying with a card that is not yours.
• Infringe anybody's copyright, trade marks or other rights through the program or the account.
• Interfere with the service or the machines it runs on: no malware, no probing or scanning for weaknesses, no scraping, and no reaching for an account or data that is not yours.

If a licence is being used in one of those ways we may suspend that key. We will tell you why, and a key suspended in error is restored.

We may likewise suspend or end access to this site and to the account behind it: for a serious or repeated breach of these terms, for a payment reversed or never made, or where we have reason to think an account is being used for fraud or is a security risk to somebody else. Where it is lawful and safe to say so, we say which of those it was. Access withdrawn in error is given back. And suspending an account does not by itself revoke a perpetual licence you paid for — a refund or a chargeback is the thing that does that, which the refund policy says in as many words.

Your account

Buying creates an account here to hold your key, your orders and your support tickets. Keep the sign-in details to yourself; you are responsible for what is done through your account. You can close it whenever you like from your account pages — closing it does not revoke a licence you have already paid for, and we will tell you what we are obliged to keep, and why, before anything is deleted.

Refunds

Refunds have their own page: see the refund policy. Nothing there or here affects the statutory rights you have where you live.

What is guaranteed, and what is not

We guarantee the program is what these pages say it is, and that it does what the version you downloaded was described as doing. If it does not, tell us — that is a bug and a reason for a refund, not a matter for argument.

Beyond that, the program is provided as it stands. We do not warrant that it is free of every defect, that it will run on every configuration of Windows, or that downloads will never be unavailable. The gallery is not a backup. It reads your pictures and builds an index beside itself; it never moves, renames, re-encodes or writes to your originals, and it is no substitute for keeping copies of them somewhere else.

So far as the law allows, our total liability to you for anything arising out of the program or these terms is limited to what you paid us in the twelve months before the claim. We are not liable for lost profits, lost data or indirect loss. Nothing here limits liability for death, personal injury or fraud, and nothing here limits a consumer's non-excludable rights.

Changes

We may change these terms — for a new feature, or because the law changed. The version in force for you is the one published when you bought, except where a change is needed to comply with the law. Material changes are announced on this page with the date above updated; they are not made quietly.

We may also stop selling the gallery, or stop publishing updates for it. Neither takes away a licence you already hold, and neither stops a build you already have from running.

Governing law

These terms are governed by the law of Pakistan, whose courts have jurisdiction over any dispute. If you are a consumer you keep the protection of the mandatory law of the country you live in, and you may bring a claim there.
